1. Your Legal Guarantee Rights
Products purchased from Moda Bagua are covered by the statutory legal guarantee of conformity provided under applicable European Union and national consumer protection law.
The legal guarantee applies independently of Moda Bagua's return policy and the 14-day right of withdrawal.
Under European Union consumer rules, consumers are entitled to a minimum legal guarantee period of two years from the date the goods are received.
Some countries may provide additional or longer protection under national law.
2. When Does The Legal Guarantee Apply?
The legal guarantee may apply when a product:
Does not correspond to its description
Does not have the characteristics presented or agreed at the time of purchase
Is not suitable for its normal intended purpose
Does not have the quality or performance that may reasonably be expected
Is damaged or defective due to a lack of conformity existing at the time of delivery
Otherwise does not conform to the sales contract
Normal wear and tear, accidental damage, misuse or damage caused by improper care is not automatically considered a lack of conformity.
3. Minimum Two-Year Protection
Under EU rules, the seller is responsible for a lack of conformity that existed when the goods were delivered and becomes apparent within the applicable legal guarantee period.
The minimum legal guarantee period for new consumer goods in the European Union is two years from delivery.
National legislation in the customer's country may provide additional protection.
4. Available Remedies
Where a valid lack of conformity exists, the customer may be entitled to legal remedies.
Depending on the circumstances and applicable law, these may include:
Repair of the product free of charge
Replacement of the product free of charge
An appropriate reduction in the price
Termination of the contract and reimbursement
Repair or replacement must be provided without charge where required by law and within a reasonable period without significant inconvenience to the consumer.
A price reduction or reimbursement may become available where repair or replacement is impossible, disproportionate, unsuccessful or cannot be provided within the legally required conditions.
5. Costs
Legal guarantee remedies are provided without charge to the customer where required by applicable law.
Moda Bagua covers the necessary return shipping costs for accepted legal guarantee claims.
Please contact us before returning a product so that the return can be organised correctly.
6. How To Make A Legal Guarantee Claim
If you believe that a product is defective or does not conform to your order, contact Moda Bagua Customer Service.

7. Proof Of Purchase
We may request reasonable proof that the product was purchased from Moda Bagua.
This may include:
Order confirmation
Invoice
Payment record
Order number
Other suitable proof of purchase
8. Assessment Of The Product
Moda Bagua may reasonably request the product to be returned or otherwise made available for inspection where this is necessary to assess the claimed lack of conformity.
Where the claim is accepted, the applicable remedy will be provided in accordance with consumer protection law.
9. Legal Guarantee And Right Of Withdrawal
The legal guarantee is different from the 14-day right of withdrawal.
The right of withdrawal generally allows consumers to change their mind about an eligible distance purchase within the applicable period.
The legal guarantee protects consumers when goods are defective or do not conform to the sales contract.
Exercising or expiry of the right of withdrawal does not remove applicable legal guarantee rights.
10. Legal Guarantee And Commercial Guarantees
A statutory legal guarantee must not be confused with a voluntary commercial guarantee or warranty that may be offered by a manufacturer or seller.
Any commercial guarantee is additional to the customer's statutory rights and cannot reduce or replace the legal guarantee.
11. Mandatory Consumer Rights
Nothing in this policy limits mandatory consumer rights provided by applicable European Union law or the mandatory consumer protection law of the customer's country of habitual residence.
